MENTERI AGRARIA DAN TATA RUANG/KEPALA BADAN PERTANAHAN  NASIONAL THE MINISTER OF AGRARIAN AFFAIRS AND SPATIAL PLANNING/HEAD OF THE  NATIONAL LAND AGENCY PERATURAN MENTERI AGRARIA DAN TATA RUANG/KEPALA BADAN PERTANAHAN NASIONAL REGULATION OF THE MINISTER OF AGRARIAN AFFAIRS AND SPATIAL PLANNING/HEAD OF THE NATIONAL LAND AGENCY  NOMOR 5 TAHUN 2015 NUMBER 5 OF 2015 TENTANG CONCERNING IZIN LOKASI LOCATION PERMITS DENGAN RAHMAT TUHAN YANG MAHA ESA WITH THE BLESSING OF GOD ALMIGHTY MENTERI AGRARIA DAN TATA RUANG/KEPALA BADAN PERTANAHAN  NASIONAL THE MINISTER OF AGRARIAN AFFAIRS AND SPATIAL PLANNING/HEAD OF THE  NATIONAL LAND AGENCY, Menimbang: Considering: a. bahwa dalam rangka memperoleh tanah untuk kepentingan penanaman modal diperlukan adanya Izin Lokasi sebelum suatu perusahaan melakukan pembebasan atau pelepasan hak atas tanah dari masyarakat; a. that to acquire acquire land for for the purpose of investment, a company shall, before a company has clear title to land from the  public, be required to hold a Location Location Permit;  b. bahwa Peraturan Menteri Negara Agraria/  b. Kepala Badan Pertanahan Nasional Nomor 2 Tahun 1999 tentang Izin Lokasi sudah tidak sesuai dengan perkembangan pembangunan dan masyarakat serta adanya keperluan  pengaturan substansi baru yang belum diatur sehingga perlu dilakukan penyesuaian; that Regulation of the State Minister for Agrarian Affairs/Head of the National Land Agency Number 2 of 1999 concerning Location Permits needs replacement as is no longer current with the thriving development and society as well as the need to establish new substance previously absent from regulation; c. bahwa berdasarkan pertimbangan sebagaimana dimaksud dalam huruf a dan huruf b, perlu menetapkan Peraturan Menteri Agraria dan Tata Ruang/Kepala Badan Pertanahan Nasional tentang Izin Lokasi; that in consideration of point (a) and point (b), it is necessary to issue a Regulation of the Minister of Agrarian Affairs/Head of the  National Agency concerning Location Permits; Mengingat: 1. Decision of the President Number 121/P of 2014 concerning Formation of Ministries and Appointment of the 2014-2019 Working Cabinet; MEMUTUSKAN: HAS DECIDED: Menetapkan: PERATURAN MENTERI AGRARIA DAN TATA RUANG/KEPALA BADAN PERTANAHAN NASIONAL TENTANG IZIN LOKASI. To Issue: REGULATION OF THE MINISTER OF AGRARIAN AFFAIRS AND SPATIAL PLANNING/HEAD OF THE  NATIONAL LAND AGENCY CONCERNING LOCATION PERMITS. BAB I CHAPTER I KETENTUAN UMUM GENERAL PROVISIONS Pasal 1 Article 1 Dalam Peraturan ini yang dimaksud dengan: In this Regulation: 1. Izin Lokasi adalah izin yang diberikan kepada  perusahaan untuk memperoleh tanah yang diperlukan dalam rangka penanaman modal yang berlaku pula sebagai izin pemindahan hak, dan untuk menggunakan tanah tersebut guna keperluan usaha penanaman modalnya. 1. Location Permit means a permit that is issued to a company to enable the company to acquire land and to use land necessary for its investment business, and that also applies as a conveyance permit. 2. Perusahaan adalah perseorangan atau badan hukum yang telah memperoleh izin untuk melakukan penanaman modal di Indonesia sesuai ketentuan peraturan perundangundangan. 2. Company means an individual or a legal entity with a license to invest in Indonesia under the laws and regulations. 3. Grup perusahaan adalah dua atau lebih badan usaha yang sebagian sahamnya dimiliki oleh seorang atau oleh badan hukum yang sama 3. Group of companies means means two or more entities whose part of their shares are owned  by the same individual or legal entity, 3  baik secara langsung maupun melalui badan hukum lain, dengan jumlah atau sifat  pemilikan sedemikian rupa, sehingga melalui  pemilikan saham tersebut dapat langsung atau tidak langsung menentukan penyelenggaraan atau jalannya badan usaha. whether directly or through a different legal entity, in such amount or nature of the shareholdings that enables the individual or the legal entity to directly or indirectly control the operation and the course of the legal entity. 4. Penanaman modal adalah segala bentuk kegiatan menanam modal, baik oleh penanam modal dalam negeri maupun penanam modal asing untuk melakukan usaha di wilayah negara Republik Indonesia. 4. Investment means any form of investing activity by both domestic investors and foreign investors to do business in the territory of the state of the Republic of Indonesia. 5. Pangan lainnya lainnya adalah kegiatan pertanian/ hortikultura, perkebunan, kehutanan,  perikanan, peternakan, perairan, dan air, baik yang diolah maupun tidak diolah yang diperuntukkan sebagai makanan atau minuman bagi konsumsi manusia, termasuk  bahan tambahan Pangan, bahan baku Pangan, dan bahan lainnya yang digunakan dalam  proses penyiapan, pengolahan, dan/atau  pembuatan makanan atau minuman. minuman. 5. Other food means any activity of agriculture/ horticulture, plantations, forestry, fisheries, animal husbandry, waters, and water, whether or not it is processed for food or drink for human consumption, including Food additives, Food raw materials, and other materials used in the process of food or drink  preparation, processing, and/or manufacturing. 6. Hak atas tanah adalah hak atas tanah sebagaimana dimaksud dalam Pasal 16 Undang-Undang Nomor 5 Tahun 1960 tentang Peraturan Dasar Pokok-Pokok Agraria. 6. Title to land means means a title to land as as referred referred to in Article 16 of Law Number 5 of 1960 concerning Basic Regulations on Agrarian Affairs. 7. Kantor Pertanahan adalah Kantor Pertanahan Kabupaten/Kota. 7. Land Office means a Land Office of the District/City. Pasal 2 Article 2 (1) Setiap Perusahaan yang telah memperoleh  persetujuan penanaman modal wajib mempunyai Izin Lokasi untuk memperoleh tanah yang diperlukan untuk melaksanakan rencana penanaman modal yang  bersangkutan. (1) A Company that is already issued with an investment approval must hold a Location Permit to enable acquiring land that is necessary to make its proposed investment. (2) Pemohon Izin Lokasi dilarang melakukan kegiatan perolehan tanah sebelum Izin Lokasi ditetapkan. (2) A Location Permit applicant is prohibited from acquiring land before a Location Permit is issued. (3) Izin Lokasi sebagaimana dimaksud pada ayat (1), tidak diperlukan dan dianggap sudah dipunyai oleh perusahaan yang bersangkutan dalam hal: (3) A Location Permit as referred to in section (1) shall not be required and be deemed to have  been held by a company where: a. tanah yang akan diperoleh merupakan  pemasukan (inbreng) dari para pemegang saham; a. land to be acquired shall be one contributed in kind ( inbreng) by the shareholders; 4  b. tanah yang akan diperoleh merupakan tanah yang sudah dikuasai oleh  perusahaan lain dalam rangka melanjutkan pelaksanaan sebagian atau seluruh rencana penanaman modal  perusahaan lain tersebut, dan untuk itu telah diperoleh persetujuan dari instansi yang berwenang;  b. land to be acquired shall be one  possessed by another company to continue the whole or any part of the  proposed investment of that company, for which approval from the competent agency has been received; c. tanah yang akan akan diperoleh diperlukan dalam rangka melaksanakan usaha industri dalam suatu kawasan industri; c. land to be acquired shall be one needed to engage in industrial business within the industrial estate; d. tanah yang akan diperoleh berasal dari otorita atau badan penyelenggara  pengembangan suatu kawasan sesuai dengan rencana tata ruang kawasan  pengembangan tersebut; d. land to be acquired shall be one originating in the area development authority or agency in accordance with the spatial planning of that area development; e. tanah yang akan akan diperoleh diperlukan untuk perluasan usaha yang sudah  berjalan dan untuk perluasan itu telah diperoleh izin perluasan usaha sesuai ketentuan yang berlaku sedangkan letak tanah tersebut berbatasan dengan lokasi usaha yang bersangkutan; e. land to be acquired acquired is one needed needed to expand the ongoing business for which the expansion has been issued a business expansion permit as regulated, as long as the land is located abutting onto the relevant business location; f. tanah yang diperlukan untuk melaksanakan rencana penanaman modal tidak lebih dari 25 Ha (dua puluh lima hektar) untuk usaha pertanian dan tidak lebih dari 10.000 m2 (sepuluh ribu meter  persegi) untuk usaha bukan pertanian; atau f. land that is needed to make the proposed investment is one not to exceed 25 Ha (twenty-five hectares) for agricultural  business, and not to exceed 10,000 m2 (ten thousand square meters) for nonagricultural business; or g. tanah yang akan dipergunakan dipergunakan untuk melaksanakan rencana penanaman modal merupakan tanah yang sudah dipunyai oleh perusahaan yang bersangkutan melalui peralihan hak dari perusahaan lain, dengan ketentuan bahwa tanah tersebut terletak di lokasi yang menurut Rencana Tata Ruang Wilayah yang  berlaku diperuntukkan bagi penggunaan yang sesuai dengan rencana penanaman modal yang bersangkutan. g. land to be used to make make the proposed investment shall be one owned by the relevant company by a conveyance from another company, as long as the land is in the location that, according to the  prevailing Regional Spatial Planning, is zoned for appropriate use of the proposed investment. (4) Dalam hal sebagaimana sebagaimana dimaksud pada pada ayat (2) perusahaan yang bersangkutan memberitahukan rencana perolehan tanah dan atau penggunaan tanah yang bersangkutan kepada Kantor Pertanahan. (4) In case of section (2), the company shall inform the Land Office of its land acquisition and use plans. 5 BAB II CHAPTER II OBJEK IZIN LOKASI OBJECTS OF LOCATION PERMITS Pasal 3 Article 3 Tanah yang dapat ditunjuk dalam Izin Lokasi adalah tanah yang menurut Rencana Tata Ruang Wilayah diperuntukan bagi penggunaan yang sesuai dengan rencana penanaman modal yang akan dilaksanakan oleh perusahaan menurut  persetujuan penanaman modal yang dipunyainya. Pasal 4 Article 4 Izin Lokasi dapat diberikan kepada perusahaan yang sudah mendapat persetujuan penanaman modal sesuai dengan ketentuan peraturan  perundang-undangan untuk memperoleh tanah dengan luas yang telah ditentukan sehingga apabila perusahaan tersebut berhasil membebaskan seluruh areal yang ditunjuk, maka luas penguasaan tanah oleh perusahaan tersebut dan perusahaan-perusahaan lain yang merupakan satu grup perusahaan dengannya tidak lebih dari luasan sebagai berikut: A Location Permit may be issued to a company already with the investment approval under the laws and regulations to acquire land with an area already specified, so if the company gains clear title to land throughout the specified area, the land tenure of the company and the other companies of the same group shall cover an area not to exceed as follows: a. a. Kawasan perumahan permukiman: For housing housing and settlements development development  business: 1) Housing/settlements areas: 1 provinsi : 400 Ha 1 province Seluruh Indonesia : 4.000 Ha Throughout Indonesia : 4,000 Ha Kawasan resort perhotelan: 2) : 400 Ha Hotel/resort areas: 1 provinsi : 200 Ha 1 province Seluruh Indonesia : 4.000 Ha Throughout Indonesia : 4,000 Ha Untuk usaha kawasan industri: b. : 200 Ha For industrial estate areas: 1 provinsi : 400 Ha 1 province : 400 Ha Seluruh Indonesia : 4.000 Ha Throughout Indonesia : 4,000 Ha Untuk usaha perkebunan yang diusahakan dalam bentuk perkebunan besar dengan diberikan Hak Guna Usaha: 1) Komoditas tebu: 1 provinsi c. For plantation business through a large  plantation with the Right to Farm: 1) : 60.000 Ha Sugar cane commodities: 1 province : 60,000 Ha 6 Seluruh Indonesia 2) d. : 150.000 Ha Komoditas Pangan lainnya: 2) 2) Other Food commodities: 1 provinsi : 20.000 Ha 1 province Seluruh Indonesia : 100.000 Ha Throughout Indonesia : 100,000 Ha Untuk usaha tambak: 1) Throughout Indonesia : 150,000 Ha d. Di Pulau Jawa : 20,000 Ha For fishpond business: 1) On the Java Island 1 provinsi : 100 Ha 1 province Seluruh Indonesia : 1.000 Ha Throughout Indonesia : 1,000 Ha Di Luar Pulau Jawa 2) : 100 Ha Outside the Java Island 1 provinsi : 200 Ha 1 province : 200 Ha Seluruh Indonesia : 2.000 Ha Throughout Indonesia : 2,000 Ha (2) Khusus untuk Provinsi Papua dan Papua Barat maksimum luas penguasaan tanah adalah dua kali maksimum luas penguasaan tanah untuk satu provinsi sebagaimana dimaksud pada ayat (1). (4) Ketentuan sebagaimana dimaksud pada ayat (1), ayat (2), dan ayat (3), tidak berlaku untuk: (4) The provisions of section (1), section (2), and section (3) shall not apply to: a. Badan Usaha Milik Negara Negara (BUMN) (BUMN) yang berbentuk Perusahaan Umum (PERUM) dan Badan Usaha Milik Daerah (BUMD); a. State-Owned Companies (BUMN), i.e. Public Enterprises (PERUM) and Region-Owned Companies (BUMD);  b. Badan Usaha yang seluruh atau sebagian  besar sahamnya dimiliki oleh Negara,  baik Pemerintah Pusat maupun Pemerintah Daerah;  b. An Entity whose shares are wholly or  partially owned by the State, whether w hether the Central Government or the Regional Governments; c. Badan Usaha yang sebagian besar sahamnya dimiliki oleh masyarakat dalam rangka "Go Public". c. An Entity Entity whose whose shares shares are majority owned by the public in the scope of "Go Public". BAB III CHAPTER III JANGKA WAKTU IZIN LOKASI TERM OF LOCATION PERMIT Pasal 5 Article 5 (1) Izin Lokasi diberikan untuk jangka waktu 3 (tiga) tahun. (1) A Location Permit shall be issued for a term of 3 (three) years. (2) Perolehan tanah oleh pemegang Izin Lokasi harus diselesaikan dalam jangka waktu Izin Lokasi. (2) A Location Permit holder must have completed the land acquisition within the term stated in the Location Permit. (3) Apabila dalam jangka waktu Izin Lokasi sebagaimana dimaksud pada ayat (1)  perolehan tanah belum selesai, maka Izin Lokasi dapat diperpanjang jangka waktunya selama 1 (satu) tahun apabila tanah yang sudah diperoleh mencapai 50% (lima puluh  persen) atau lebih dari luas tanah yang ditunjuk dalam Izin Lokasi. (4) Format Keputusan Perpanjangan Izin Lokasi sebagaimana dimaksud pada ayat (3) dibuat sesuai contoh sebagaimana tercantum dalam Lampiran I yang merupakan bagian tidak terpisahkan dari Peraturan ini. (5) Apabila dalam jangka waktu Izin Lokasi sebagaimana dimaksud pada ayat (1)  perolehan tanah kurang dari 50% (lima puluh  persen) dari luas tanah yang ditunjuk dalam Izin Lokasi, maka Izin Lokasi tidak dapat diperpanjang. (5) If within the term of Location Permit as referred to in section (1) land already acquired is less than 50% (fifty percent) of the land area as specified in the Location Permit, such a Location Permit may not be extended. Pasal 6 Article 6 (1) Pemberian Izin Lokasi sebagaimana dimaksud dalam Pasal 5 disertai dengan Peta sebagaimana tercantum dalam Lampiran II yang merupakan bagian tidak terpisahkan dari Peraturan ini. (2) Pemegang Izin Lokasi hanya dapat memperoleh tanah sesuai dengan peta sebagaimana dimaksud pada ayat (1). (2) A Location Permit Holder Holder may acquire land as shown on the map as referred to in section (1). Pasal 7 Article 7 Tanah yang sudah diperoleh wajib didaftarkan  pada Kantor Pertanahan setempat. Land already acquired must be registered with the local Land Office. Pasal 8 Article 8 (1) Tanah yang sudah dimanfaatkan/digunakan  peruntukannya. diperoleh wajib sesuai dengan (1) Land already acquired must be utilized/used according to its land zoning. (2) Dalam hal di atas tanah sebagaimana dimaksud pada ayat (1), terdapat  pengembangan pemanfaatan tanah sepanjang sesuai dengan peruntukannya, tidak diperlukan Izin Lokasi baru. (3) Surat Keputusan pemberian Izin Lokasi ditandatangani oleh Bupati/Walikota atau, untuk Daerah Khusus Ibukota Jakarta setelah diadakan rapat koordinasi antar instansi terkait, yang dipimpin oleh Gubernur Kepala Daerah Khusus Ibukota Jakarta, atau oleh  pejabat yang ditunjuk. (3) A Decision concerning the issuance of a Location Permit shall be signed by the Regent/Mayor or, for the Jakarta Special Capital Region, upon a coordinating meeting of the relevant agencies, by the Governor of the Jakarta Special Capital, or a designee. (4) Untuk pemberian Izin Lokasi lintas kabupaten/kota dalam 1 (satu) provinsi, ditandatangani oleh Gubernur. (4) A Decision concerning the issuance of a Location Permit for land overlapping the districts/cities in 1 (one) province shall be signed by the Governor. (5) Untuk pemberian Izin Lokasi lintas provinsi, ditandatangani oleh Menteri Agraria dan Tata Ruang/Kepala Badan Pertanahan Nasional. (5) A Decision concerning the issuance of a Location Permit for land overlapping the  provinces shall be signed by the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency. (6) Format Keputusan pemberian Izin Lokasi sebagaimana dimaksud pada ayat (1) dibuat sesuai contoh sebagaimana tercantum dalam Lampiran III yang merupakan bagian tidak terpisahkan dari Peraturan ini. (6) The sample format of Decision concerning the issuance of a Location Permit as referred to in section (1) is provided in Appendix III, made an inseparable part of this Regulation. (7) Dalam hal telah diterbitkan keputusan  pemberian Izin Lokasi sebagaimana dimaksud  pada ayat (6), dilarang menerbitkan Izin Lokasi baru untuk subjek yang berbeda di atas tanah yang sama. (7) Where a decision concerning the Location Permit has been issued as referred to in section (6), no new Location Permit is allowed to be issued on the same land with a different subject. (8) Dalam hal diterbitkan Izin Lokasi baru sebagaimana dimaksud pada ayat (7), maka Izin Lokasi baru tersebut batal demi hukum. (8) Where a new Location Permit is issued as referred to in section (7), such new Location Permit shall be void by operation of law. Pasal 10 Article 10 (1) Bahan-bahan untuk keperluan pertimbangan teknis pertanahan dan rapat koordinasi sebagaimana dimaksud dalam Pasal 9 dipersiapkan oleh Kepala Kantor Pertanahan. Pemberian kesempatan kepada pemegang hak atas tanah untuk memperoleh  penjelasan tentang rencana penanaman modal dan mencari alternatif pemecahan masalah yang ditemui;  b. Provision of opportunities to the title holders to receive any explanation about the  proposed investment and to seek alternatives to resolution of any issue they face; c. Pengumpulan informasi langsung dari masyarakat untuk memperoleh data sosial dan lingkungan yang diperlukan; dan c. Collection of information directly from the communities in order to have necessary access to social and environmental data; and d. Peran serta masyarakat berupa usulan tentang alternatif bentuk dan besarnya ganti kerugian dalam perolehan tanah dalam pelaksanaan Izin Lokasi. d. Participation of the communities by  providing suggestions on the alternatives to the form and amount of compensation for land acquisition with respect to the Location Permit. Pasal 11 Article 11 Dalam hal di atas tanah Izin Lokasi diterbitkan izin usaha pertambangan dan/atau izin usaha lainnya, maka terlebih dahulu mendapat  persetujuan dari pemilik tanah atau pemegang Izin Lokasi. BAB V CHAPTER V HAK DAN KEWAJIBAN PEMEGANG IZIN LOKASI RIGHTS AND OBLIGATIONS OF LOCATION PERMIT HOLDERS Pasal 12 Article 12 (1) Pemegang Izin Lokasi diizinkan untuk membebaskan tanah dalam areal Izin Lokasi dari hak dan kepentingan pihak lain  berdasarkan kesepakatan dengan pemegang hak atau pihak yang mempunyai kepentingan tersebut dengan cara jual beli, pemberian ganti kerugian, konsolidasi tanah atau cara lain sesuai ketentuan yang berlaku. (1) A Location Permit holder is permitted to have clear title to land within the Location Permit area from other parties’ rights and interests under an agreement with the title holder or a  party with such interest by purchase, compensation, land consolidation or other methods in compliance with the regulations. (3) Pemegang Izin Lokasi wajib menghormati kepentingan pihak-pihak lain atas tanah yang  belum dibebaskan sebagaimana dimaksud  pada ayat (1), tidak menutup atau mengurangi aksesibilitas yang dimiliki masyarakat di sekitar lokasi, dan menjaga serta melindungi kepentingan umum. (3) A Location Permit holder must honor the other parties’ interests in the land not yet released as referred to in section (1), shall not  block or delimit the public access around the location, and shall maintain as well as protect the public interest. (4) Sesudah tanah yang bersangkutan bersangkutan dibebaskan dari hak dan kepentingan lain, maka kepada  pemegang Izin Lokasi dapat diberikan hak atas tanah yang memberikan kewenangan kepadanya untuk menggunakan tanah tersebut sesuai dengan keperluan untuk melaksanakan rencana penanaman modalnya. (4) Once the land is free from the rights and interests of other parties, the Location Permit holder shall be entitled to the land and empowered to use it as necessary to make its  proposed investment. Pasal 13 Article 13 Pemegang Izin Lokasi berkewajiban untuk melaporkan secara berkala setiap 3 (tiga) bulan kepada Kepala Kantor Pertanahan mengenai  perolehan tanah yang sudah dilaksanakannya  berdasarkan Izin Lokasi dan pelaksanaan  penggunaan tanah tersebut. A Location Permit holder must report to the Head of the Land Office the completion of the land acquisition under the Location Permit and implementation of the land use at regular intervals once every 3 (three) months. months . (3) Penyelenggaraan monitoring dan evaluasi sebagaimana dimaksud pada ayat (2) untuk Izin Lokasi dilaksanakan dengan memperhatikan Surat Keputusan Izin Lokasi. (3) Monitoring and evaluation of Location Permits as referred to in section (2) shall be conducted with due regard to the Decision concerning the Location Permit. (4) Hasil monitoring dan evaluasi sebagaimana dimaksud pada ayat (3) menjadi bahan  pertimbangan dalam Pembatalan Izin Lokasi. Lokasi. (4) The results of monitoring monitoring and evaluation as referred to in section (3) shall be taken into consideration for cancelling Location Permits. (5) Pembatalan Izin Lokasi sebagaimana dimaksud pada ayat (4) dilaksanakan oleh Menteri Agraria dan Tata Ruang/Kepala Badan Pertanahan Nasional atas usulan: (5) Location Permits as referred to in section (4) shall be cancelled by the Minister of Agrarian Affairs and Spatial Planning/Head of the  National Land Agency upon the recommendation of: a. Kepala Kantor Wilayah BPN Provinsi; dan a. The Head of the Regional Office of the  National Land Agency of the Province; and  b. Kepala Kantor Pertanahan Kabupaten/ Kota.  b. A Location Permit holder is permitted to have clear title to land within the Location Permit area from other parties’ rights and interests under an agreement with the title holder or a party with such interest by release of rights or purchase, compensation, land relocation/consolidation or other methods in compliance with the prevailing regulations. 2. After obtaining Decision concerning concerning a Location Permit, Permit, the Location Permit Permit holder must inform and socialize the communities in the location being applied for. 3. Before title to land passes to a Location Permit holder under section (1), other  parties’ existing rights or interests in the land shall not diminish and remain acknowledged, including the power that by law still remains with the title holder to obtain title deeds (certificates), and the power to use and utilize their land for  personal or business purposes according to the prevailing land zoning, and the  power to convey them to other other parties. 4. A Location Permit holder must honor the other parties’ interests in the land not yet released, shall not block or delimit the public access around the location, and shall maintain as well as protect the public interest. 5. Land acquisition must be completed within 3 (three) years of the date this Decision is issued with extension of not to exceed ….. (in words) years, and the Location Permit holder must report to the Head of the Land Office of the District/City of ….. **) at regular intervals once every 3 (three) months. 6. A Location Permit holder may acquire land as shown on the map of the Location Permit.. Permit 7. A Location Permit Holder that acquires land outside the location as specified in the Location Permit shall have its acquisition of title to land left unprocessed. 8. Menimbang:

Considering:

a.

bahwa dalam rangka memperoleh tanah untuk a.
kepentingan penanaman modal diperlukan
adanya Izin Lokasi sebelum suatu perusahaan
melakukan pembebasan atau pelepasan hak
atas tanah dari masyarakat;

Article 1

KETENTUAN UMUM
Pasal 1
Dalam Peraturan ini yang dimaksud dengan:

In this Regulation:

1.

Izin Lokasi adalah izin yang diberikan kepada 1.
perusahaan untuk memperoleh tanah yang
diperlukan dalam rangka penanaman modal
yang berlaku pula sebagai izin pemindahan
hak, dan untuk menggunakan tanah tersebut
guna keperluan usaha penanaman modalnya.

Location Permit means a permit that is issued
to a company to enable the company to
acquire land and to use land necessary for its
investment business, and that also applies as a
conveyance permit.

2.

Perusahaan adalah perseorangan atau badan 2.
hukum yang telah memperoleh izin untuk
melakukan penanaman modal di Indonesia

Company means an individual or a legal
entity with a license to invest in Indonesia

Hak atas tanah adalah hak atas tanah 6.

Title to land means a title to land as referred
to in Article 16 of Law Number 5 of 1960

Affairs.

Tanah yang dapat ditunjuk dalam Izin Lokasi
adalah tanah yang menurut Rencana Tata Ruang
Wilayah diperuntukan bagi penggunaan yang
sesuai dengan rencana penanaman modal yang
akan dilaksanakan oleh perusahaan menurut
persetujuan penanaman modal yang dipunyainya.

the prevailing laws and regulations.
The Rights and Obligations of the Permit Holder:
1. A Location Permit holder is permitted to have clear title to land within the
Location Permit area from other parties’ rights and interests under an agreement
with the title holder or a party with such interest by release of rights or purchase,
compensation, land relocation/consolidation or other methods in compliance with
the prevailing regulations.
2. After obtaining Decision concerning a Location Permit, the Location Permit
holder must inform and socialize the communities in the location being applied
for.
3. Before title to land passes to a Location Permit holder under section (1), other
parties’ existing rights or interests in the land shall not diminish and remain
acknowledged, including the power that by law still remains with the title holder
to obtain title deeds (certificates), and the power to use and utilize their land for
personal or business purposes according to the prevailing land zoning, and the
power to convey them to other parties.
4. A Location Permit holder must honor the other parties’ interests in the land not
yet released, shall not block or delimit the public access around the location, and
shall maintain as well as protect the public interest.
5. Land acquisition must be completed within 3 (three) years of the date this
Decision is issued with extension of not to exceed ….. (in words) years, and the
Location Permit holder must report to the Head of the Land Office of the
District/City of ….. **) at regular intervals once every 3 (three) months.
6. A Location Permit holder may acquire land as shown on the map of the Location
Permit.
7. A Location Permit Holder that acquires land outside the location as specified in
the Location Permit shall have its acquisition of title to land left unprocessed.
8. A Location Permit Holder must use and utilize land it has acquired according to
the land zoning.
9. A Location Permit Holder must register the land it has acquired with the local
Land Office.
This Location Permit is not the entitlement to land and is issued to the applicant to
fulfill licensing formalities with the competent agencies.
In case in the future any final and binding order/decision is made against the use of
other land located in the Location Permit area of PT ….., this decision concerning the
issuance of Location Permit will be further reviewed.
This Decision shall be valid for 3 (three) years of the date it is issued, provided that,
any error in this decision found at a later date shall be revised and corrected as
